GENERAL TERMS OF USE AND SALE

APPLICATION OF THE GENERAL TERMS AND CONDITIONS 
Scope 

These general terms of use and sale (hereinafter the "GTC/GTS") govern, without restriction or reservation, the conditions of access and use of the website available at the following URL: https://personalsellerparis.com (hereinafter the "Site") published by the company PERSONAL SELLER PARIS (hereinafter " the Company "), and any user of the Site regardless of their status (simple visitor to the Site, subscriber to a newsletter, user registered to the reserved part of the Site) (hereinafter the "User"). 

PERSONAL SELLER PARIS reserves the right to unilaterally adapt or modify these GTC/GTS at any time and without notice. The applicable version of the GTC/GTS is that on the date the User visits the Site or logs into their Personal Account. These GTC/GTS are written in French. 

Acceptance of the GTC/GTS 

These GTC/GTS are accessible to Users and more generally to any internet user directly by clicking on the link "General Terms of Use and Sale" on all pages of the Site. 

The User's visit to the Site therefore implies full and unreserved adherence to all GTC/GTS, except for articles 6 to 10 which are reserved for Users who subscribe to subscriptions offered by PERSONAL SELLER PARIS. 

Any order placed by the User is conditional on the User's prior and unreserved online consultation and acceptance of the GTC/GTS by checking the box "By checking this box, I accept the General Terms of Use and Sale". The order of Services by the User therefore implies full and unreserved adherence to the GTC/GTS. 

DESCRIPTION OF SERVICES

PERSONAL SELLER PARIS is a company specialized in personal selling services for individuals. The Site thus allows the sale of clothing and accessories on a digital platform.

The Company offers tailor-made services, including a visit to the User's home for a turnkey service: collection of items, inventory, photo taking, storage, negotiation of sales with potential buyers, shipments, payments, or other services.

The User may: 

• Place one or more orders for items;

• Track the status of their ongoing orders;  

• Access their invoices. 

Furthermore, to place an order for items, the User must: 

• Follow the instructions on the Site and, in particular, the instructions necessary to log in to the Account and, if applicable, to open an Account;

• Select the item(s) of their choice, it being specified that the selection of items chosen by the User may no longer be available depending on the time taken to validate the order. The User will then have to restart their item selection from the beginning;

• Check the elements of the order and, if applicable, modify the selection of items and/or correct the delivery and/or billing information;

• Validate the order;

• Choose a payment method;

• Follow the instructions of the online payment service to proceed with the secure payment of the order amount. 

To optimize its Users' searches, PERSONAL SELLER PARIS offers the use of detailed tabs. These aim to allow the User to find a product that matches their desires.

OBLIGATIONS, LIABILITIES AND GUARANTEES 
Technical

PERSONAL SELLER PARIS implements the necessary means and measures for the proper functioning and maintenance of the continuity and quality of the Services.

The User acknowledges that PERSONAL SELLER PARIS cannot be held responsible for an interruption of Services or a delay in execution not within its control and, in particular, that the provision of Services depends on the reliability, availability and continuity of connections of a number of third parties as well as the accuracy and integrity of the information provided by the User. 

PERSONAL SELLER PARIS may be required to suspend the Services for maintenance scheduled by PERSONAL SELLER PARIS or one of its subcontractors or in case of technical imperative.

It is understood between the Parties that PERSONAL SELLER PARIS cannot in any case be held responsible for repairing any indirect damages suffered by Users during the use of the Services.

Furthermore, the responsibility of PERSONAL SELLER PARIS cannot be sought for acts (i) resulting from an act or negligence on the part of the User, (ii) which would not comply with applicable regulations and/or the GTC/GTS (iii) in the event of force majeure within the meaning of article 1218 of the Civil Code and current case law. 

Commercial

The items for sale on the Site are second-hand items, so the available stock may be limited to a few copies or even a single copy. The availability of an item may therefore vary depending on the time required to update the Site. The Site is updated approximately every 2 hours. 

Consequently, the User will be immediately informed by PERSONAL SELLER PARIS, by email, of the unavailability of the selected item when placing an order. In no case can the Company be held liable for the unavailability of an item.

Each item for sale has a description sheet detailing all its characteristics such as, in particular, the brand, material, size, color, and condition. The condition of the item offered is particularly specified, according to the following nomenclature: 

"Never worn with tag" : the item has never been worn and has its original tag

• "New condition" or "Never worn": the item appears new and is flawless, 

• "Very good condition": the item has been little used and remains in very good condition. It may have some apparent defects, 

• "Good condition": the item is well maintained and shows slight signs of use

• "Fair condition": the item shows marked signs of wear. 

The Company undertakes to offer products corresponding to the condition described on the Site at the time of the order.

However, in no case can the company be held responsible for the origin of the products offered for sale.

Thus, the User understands and assumes the risk inherent in second-hand sales, and waives the right to hold PERSONAL SELLER PARIS responsible for a hypothetically illicit or fraudulent origin of the product offered.

The Company also reserves the right to refuse to sell any product whose origin appears doubtful, without this sovereign decision being subject to challenge.

PERSONAL ACCOUNT 

The User is not required to register to access the Real Estate Listings. Nevertheless, when the User wishes to benefit from the Services offered by PERSONAL SELLER PARIS, they must create a Personal Account. This Personal Account is for private use and allows them to use the Services thanks to the identifiers they have provided (hereinafter the "Personal Account"). The identifier consists of the User's email address and the password they have defined (hereinafter the "Identifiers"). 

Creation of a Personal Account

When registering on the Site, the User undertakes to provide accurate and complete information about their identity. They undertake (i) not to create a false identity likely to mislead PERSONAL SELLER PARIS and (ii) not to impersonate another person. 

The User undertakes to immediately update, in the event of modification, the information they provided during their first connection to their Personal Account.

The creation of a Personal Account requires the User to provide the Site with the following information: 

• First name
• Last name
• Email
• Password

The validation of the creation of the Personal Account is confirmed by sending an email to the User at the email address they provided. The User must ensure that the email address provided when creating their Personal Account is correct. 

 

In the event that the User provides false, inaccurate, outdated, incomplete or misleading information, PERSONAL SELLER PARIS may, immediately without notice or compensation, suspend access to the User Account and deny them temporary or permanent access to all or part of the Services.

User Identifiers

User Identifiers are confidential. The User undertakes to keep them secret and not to disclose them in any form whatsoever. 

The password set by the User can be changed at any time online by the User themselves on their Personal Account by clicking on "Change password". In the event that the User loses their password, they can generate a new one by clicking on the hyperlink "Forgot password?" available on the login page to their Personal Account.

 

The User is solely responsible for the use made of their Identifiers, especially if they pre-register them on equipment, thereby allowing automatic connection to their Personal Account. Any access, use of the Services and transmission of data carried out from the Personal Account will be deemed to have been carried out by the User. In this regard, the User is required to ensure that at the end of each session they effectively log out of their Personal Account, particularly when accessing it from a public computer.

PERSONAL SELLER PARIS cannot be held responsible for any direct or indirect damage suffered by the User or by third parties, resulting from fraudulent access to the User's account, following the disclosure of their identification elements.

Termination of the Personal Account

The User may delete their Personal Account at any time by sending an email to the following address: personalsellerparis@gmail.com.

PERSONAL SELLER PARIS reserves the right to delete the account of any User who does not comply with these GTC/GTS, the various laws and regulations in force, or whose behavior is likely to harm the reputation of PERSONAL SELLER PARIS. PERSONAL SELLER PARIS may terminate, by any means, all or part of the Services with seven (7) days' notice from the effective suspension and without compensation.

GENERAL OBLIGATIONS OF THE USER

The User undertakes to:

• Comply with the terms of the GTC/GTS;

• Provide PERSONAL SELLER PARIS with all supporting documents, without limitation, to certify the information provided;

• Communicate to PERSONAL SELLER PARIS, within the agreed deadlines, all information necessary for the provision of the Services and to update the information provided in writing. The User is solely responsible for the consequences related to a default or delay in updating said information;

• Restrict access and observe the utmost confidentiality regarding the methods of access to the Services, whatever they may be;

• Use the Services in compliance with applicable laws and regulations and the GTC/GTS;
• Communicate information that does not harm the rights of third parties and be authorized to disseminate it; 

• Use the Site and the Services exclusively for private purposes. The Services may not be used for commercial or lucrative purposes; 

• Indemnify PERSONAL SELLER PARIS, its representatives from all costs (including fees, legal costs and expenses) and damages related to claims and legal actions relating to (i) the use of the Services by the User in an illegal, immoral or fraudulent manner; (ii) the information they provide and its use by PERSONAL SELLER PARIS; (iii) the violation of Intellectual Property rights of PERSONAL SELLER PARIS as well as any third party, due to the User's use of the Services.

PRICE OF SERVICES AND PAYMENT CONDITIONS

The prices of the invoiced Services are those displayed on the Site at the time the order is validated by the User. Prices are indicated in euros, all taxes included (TTC). The prices of the Services do not constitute offers that would bind PERSONAL SELLER PARIS beyond the date on which the order was placed. PERSONAL SELLER PARIS reserves the right to change its prices at any time without prior notice.

Payment of the price by the User is made by one of the following payment methods:

• By bank card (Carte Bleue, VISA, VISA Electron, Eurocard/Mastercard, Maestro),
• Apple Pay

In the event of payment by bank card, the transaction is debited immediately after verification of the User's bank card data, upon receipt of the debit authorization from the issuing bank of the said bank card.

In accordance with article L.132-2 of the Monetary and Financial Code, the commitment to pay by means of a payment card is irrevocable. By providing their bank card information, the User authorizes PERSONAL SELLER PARIS to debit their bank card for the corresponding amount.

To this end, the User must confirm, during the payment process, that they are the holder of the bank card to be debited and that the name on it is indeed theirs.

Should debiting the price be impossible, the online sale will be immediately and automatically terminated.

ORDER CONFIRMATION, MODIFICATION, AND CANCELLATION
Order confirmation

After the User has completed and validated payment on the Site, PERSONAL SELLER PARIS will send them an order confirmation email summarizing the Services ordered, the price of the Services ordered, the date or period within which PERSONAL SELLER PARIS undertakes to perform the Services, PERSONAL SELLER PARIS's contact details, the GTC/CGV applicable at the time of sale, and a withdrawal form.

Order cancellation by PERSONAL SELLER PARIS

In the event of a refusal of bank card payment authorization reported by the User's bank or any other payment incident, the order for Services will be canceled, unless the User promptly provides PERSONAL SELLER PARIS with another accepted payment method.

In any event, PERSONAL SELLER PARIS reserves the right not to confirm an order for any reason whatsoever, particularly due to a problem relating to the order received or the information provided by the User. In the event of an order cancellation, the User will be reimbursed for all fees already paid.

DELIVERY OF ITEMS




Delivery methods

Delivery is available worldwide, with exceptions (see here for shipments handled by Colissimo and here for shipments handled by Mondial Relay)

The User is informed that delivery costs are their responsibility (excluding exceptional promotional operations).

In this regard, when placing the order, the User chooses one of the delivery methods offered on the Site.

The available delivery methods are as follows:

• By courier only for deliveries within inner Paris;

• By Mondial Relay or Colissimo

The amount of delivery costs, any customs duties, and any other potential taxes, depends notably on the delivery method chosen by the User and the destination country.

Delivery times

Delivery times are as follows:

• 4 to 6 working days from order validation for delivery in metropolitan France (excluding Corsica);

• 4 to 10 working days from order validation for delivery in Corsica, French overseas territories, and Europe;

• 4 to 10 working days for delivery to the rest of the world.

Delivery times are given in working days and correspond to average preparation and shipping times.

The User will receive an email informing them of their order shipment. In case of delivery delay, the order is not canceled. PERSONAL SELLER PARIS will then inform the User of the situation.

Users with an account can track the progress of their order on it.

Order verification and receipt

The User is obliged to check the condition of the packaging and the purchased items upon receipt.

It is the User's responsibility to make any reservations and claims they deem necessary, or even to refuse the parcel, when it is visibly damaged upon delivery. These reservations and claims must be addressed to the carrier by registered letter with acknowledgment of receipt within three (3) working days following delivery.

The User must send PERSONAL SELLER PARIS a copy of the letter addressed to the carrier.

WITHDRAWAL PERIOD

The User has a right of withdrawal which they can exercise within fourteen (14) calendar days following the date of receipt or collection of the order. If this period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day.

Users wishing to exercise their right of withdrawal must return the items concerned within the aforementioned period to the following address: PERSONAL SELLER PARIS - 11 rue Laugier 75017 Paris.

The User must return the items in their original packaging, if applicable, accompanied by all accessories, labels, instructions, or other documents.

The User must also send an email to PERSONAL SELLER PARIS, to inform them of the exercise of their right of withdrawal, to the following address: personalsellerparis@gmail.com

INTELLECTUAL PROPERTY

Trademarks, logos, documents, studies, domain names, images, videos, texts, know-how, and more generally any other information subject to intellectual property rights related to the Services are and remain the exclusive property of PERSONAL SELLER PARIS. No transfer of intellectual property rights is made through these GTC/CGV.

The User may only use or refer to the trademarks, logos, documents, software supporting the programs, methodologies, studies, domain names, images, videos, texts, know-how, and any other intellectual property right belonging to PERSONAL SELLER PARIS with the express, written, and prior authorization of PERSONAL SELLER PARIS.

In this regard, PERSONAL SELLER PARIS reserves the right to object to, stop, and seek compensation for any use of its intellectual property rights that it considers to be counterfeiting, unfair, constituting acts of parasitism, or contrary to its image or rights it has granted.

PERSONAL DATA PROTECTION

Browsing the Site, subscribing to Services by the User, and the provision of these by PERSONAL SELLER PARIS involve the processing of personal data. To learn more about the processing carried out using their data, the User is invited to consult the PERSONAL SELLER PARIS Privacy Policy accessible via the following link: [https://personalsellerparis.com/].

MISCELLANEOUS PROVISIONS
Assignment

PERSONAL SELLER PARIS may assign these GTC/CGV, as well as all rights and obligations attached thereto, to any third party, without prior agreement from the User, particularly in the event of a sale of a business branch, a merger by creation of a new company, a merger by acquisition, a spin-off, or any change of control affecting the Company.

Severability

In the event that any provision of these GTC/CGV is found to be void, it shall be deemed unwritten, and the other provisions shall retain their force and scope.

Waiver

The fact that PERSONAL SELLER PARIS does not at any given time avail itself of any stipulation cannot be interpreted as a waiver of the benefit of that stipulation or of the right to avail itself of the said stipulation at a later date and/or to seek compensation for any breach of that stipulation.

DISPUTE RESOLUTION AND APPLICABLE LAW
Complaint

In the event of a complaint or dispute relating to the conditions of access or use of the Site, before any recourse to a mediation procedure or judicial action, the User undertakes to contact PERSONAL SELLER PARIS first by email at the following address: personalsellerparis@gmail.com

Mediation

In the event of a dispute between the parties and following a failed complaint (as described in the article above) by the User to PERSONAL SELLER PARIS or in the absence of a response from PERSONAL SELLER PARIS within a reasonable period of one (1) month, the User may resort to any alternative dispute resolution method.

The User remains free to accept or refuse recourse to mediation and, in the event of recourse to mediation, each party is free to accept or refuse the solution proposed by the mediator.

Applicable law and jurisdiction

All provisions appearing in the GTC/CGV are subject to French law, and French courts shall have sole jurisdiction.

Return and Refund Policy

You have a period of 14 days from the date of receipt of your order to return your purchases to Personal Seller at the following address: 11 rue laugier - 75017 Paris

Return shipping costs are the responsibility of the buyer.

The buyer must send an email to the following address to express their wish to return the item(s): personalsellerparis@gmail.com.

Items must be returned with their "Personal Seller" tags intact and attached.
